Can a man do mutah with a women whose faith and religion is not known to him. Is it necessary for him to inquire about her faith and religion.What if he does Mutah without inquiring about her faith and religion. |

A: It is lawful to temporarily marry a Muslim, a Christian or a Jew woman and you are not allowed to marry women believe in other religions. You must make sure she believes in one of the three religions. |

Q2:
I was wondering what my duty is if I wanted to contract a temporary marriage with a
Christian who does not know anything about it. Must she say the Arabic, or can we say the aqd
-marriage contract - in English? |

A: She does not have to recite in Arabic if she can not but you must not marry such women
unless they realize that the mentioned relation is marriage contract with
religious commitments. |

Q3:
If a man
who is married to a Muslim wife, but contracts temporary marriage with a non-Muslim from Ahlul
Kitab without the knowledge or permission of his Muslim wife, will
he have committed a sin (haram act) that is punishable on the Day of
Judgment? |

A: Yes,
He committed a sin and the marriage is void if it
was without the permission of the Muslim wife. |

Q4:
If a Muslim man is married temporarily to a Muslim woman, is it permissible for him to contract a temporary marriage with a Christian woman if the Muslim wife gives permission for such? |

A: Yes, it is permissible. |

Q5: I did muta with a woman while i was permenatly married to another.i had
sexual intercourse with that women who read the shahdatain in english (
there is no god but alah and mohammed is the prophet of allah) for the
sake of making her halal for me in mutah. She was a sikh before that. she
only gave shahada for the sake of marriage while she still had doubts
about Islam. Does that make her a muslim and did i commit adultry? If i
did commit adultry, is my permanent muslim wife halal for me? I have not
consumated the marriage with my permanent wife yet and we also do not live
together but we did nikah and we do see each other regularly. |

A: If she pronounced the Shahadatain with the acknowledgment to its meanings and guarding to its content in such a way that she sees herself because of this among the Muslims, then she is considered one and your marriage with her is legitimate.
If her recitation was apparent and not real and without accepting the contents of the Shahadatain, then she is not a Muslim and your relationship with her was adultery.
The said auditory does not effect your relationship with your present permanent wife.

Marriage is Mustahab - recommended - but does this apply to nikaah - permenant marriage - or to muta - temporary marriage - as well? |

A: Yes, it applies
to the temporary marriage also unless it involves another issue that would lead
to the preference of giving up the temporary marriage. |

Can a person do Temporary marriage if his wife is away for more then a
month? |

A: Yes, he is allowed. |

Q8:
Amongst the young generation it is almost IMPOSSIBLE now to find a
girl for mut'aa to gratify sexual needs in the West and also in
the East. Can't we be allowed to do mut'aa with prostitutes for
sexual pleasure? |

A: It is permissible to marry a prostitute temporarily provided that she understands that it is a religious contract for marriage and not a fee
for adultery. |

Is it permissible to have mutaa - temperary marriage - with a woman who commits adultery with
men? Is it permissible to have mutaa with a woman who probably
commits prostitution and adultery as a job? |

A: Yes, it is allowed in both cases. |

Q10:
You have stated to a previous question that it is permissible to do mutah
with a prostitute here in the West, where it is almost impossible to
find a girl to do mutah with. However, you have stated that she, the
prostitute or woman, must know it is a religious contract, and not a
fee for adultery. Would it be permissible for the man to make the
intention to fulfill his religious duties, settle on a dollar amount
(dowry) and time limit with the woman, even if the woman still believes
the money is a fee for adultery? I ask this because I would imagine few
prostitutes in the west have heard of the concept of temporary
marriage. I would also add that the proper safety precautions are
taken. |

A: Temporary marriage is a contract between two parties to find a marital
relation between them. If the woman does not understand the mentioned
relation as a marital one but as a fee to adultery then the marriage did not
occur and the relation is not religious. |
